NOTICE Pursuant to the Land Recycling and Environmental Remediation Standards Act, the act of May 19, 1995, P.L. 4, No. 1995-2. ("Act 2"), notice is hereby given that Eastern Metal Recycling, LLC has submitted to the Pennsylvania Department of Environmental Protection ("PADEP") an Amended Notice of Intent to Remediate ("Amended NIR") for a site located at the former Foamex Facility, 1500 East Second Street, Eddystone Borough, Delaware County. This Amended NIR states that site soils and groundwater have been found to be impacted by VOCs, PAHs and metals. Impacted soils were excavated and a Final Report demonstrating attainment of statewide standards was approved by PADEP on February 25, 2011. Additional groundwater sampling will be performed to demonstrate attainment of statewide health and site-specific standards. No future use of the property is currently planned; however, the future use will likely be non-residential. Eastern Metal Recycling, LLC plans to use the statewide health and site-specific standards at the site. The Act provides for a 30-day public comment period for site-specific standard remediations. The 30-day comment period is initiated with the publication of this notice. Until September 9, 2013, Eddystone Borough may submit a request to Eastern Metal Recycling, LLC to be involved in the development of the remediation and reuse plans for the site. Eddystone Borough may also submit a request to Eastern Metal Recycling, LLC during this 30-day comment period to develop and implement a public involvement plan.
